{"id":21032,"date":"2026-04-28T17:04:59","date_gmt":"2026-04-28T20:04:59","guid":{"rendered":"https:\/\/fmgente.com.ar\/web\/reforma-laboral-el-gobierno-obtuvo-otro-fallo-favorable-y-no-se-tramitara-en-la-justicia-del-trabajo\/"},"modified":"2026-04-28T17:04:59","modified_gmt":"2026-04-28T20:04:59","slug":"reforma-laboral-el-gobierno-obtuvo-otro-fallo-favorable-y-no-se-tramitara-en-la-justicia-del-trabajo","status":"publish","type":"post","link":"https:\/\/fmgente.com.ar\/web\/reforma-laboral-el-gobierno-obtuvo-otro-fallo-favorable-y-no-se-tramitara-en-la-justicia-del-trabajo\/","title":{"rendered":"Reforma laboral: El Gobierno obtuvo otro fallo favorable y no se tramitar\u00e1 en la Justicia del Trabajo"},"content":{"rendered":"<p>Buenos Aires, 28 abril (NA) \u2013 La C\u00e1mara Nacional de Apelaciones en lo Contencioso Administrativo Federal resolvi\u00f3 este martes que la causa iniciada por la CGT contra el Estado Nacional por la constitucionalidad de la reforma laboral deber\u00e1 tramitarse en ese fuero y no en la Justicia Nacional del Trabajo.<\/p>\n<p>El fallo, en l\u00ednea con el pedido que hab\u00eda hecho la Casa Rosada, fue firmado por los jueces Rogelio Vincenti y Marcelo Daniel Duffy, integrantes de la Sala IV, confirm\u00f3 la Agencia Noticias Argentinas. <\/p>\n<p>Seg\u00fan indicaron fuentes judiciales, el conflicto se origin\u00f3 cuando el Juzgado Nacional en lo Contencioso Administrativo Federal N\u00b012 se declar\u00f3 competente para intervenir en la causa. En ese marco, el Juzgado Nacional del Trabajo N\u00b063 rechaz\u00f3 ese criterio y dispuso remitir las actuaciones a la C\u00e1mara del Trabajo.<\/p>\n<p>Por eso, la C\u00e1mara resolvi\u00f3 que le corresponde intervenir para dirimir la contienda y determin\u00f3 que el expediente debe continuar en el fuero contencioso administrativo federal, de acuerdo con lo establecido en la ley 26.854 y la jurisprudencia de la Corte Suprema.<\/p>\n<p>En su resoluci\u00f3n, el tribunal cuestion\u00f3 el tr\u00e1mite adoptado por el juzgado laboral, al se\u00f1alar que se apart\u00f3 del procedimiento previsto para este tipo de planteos y gener\u00f3 un conflicto innecesario que afecta la celeridad del proceso.<\/p>\n<p>Al analizar la cuesti\u00f3n, los camaristas consideraron que el caso involucra aspectos federales que exceden el \u00e1mbito del derecho laboral, entre ellos la validez de una ley del Congreso y la organizaci\u00f3n de la competencia judicial, lo que justifica la intervenci\u00f3n del fuero contencioso administrativo.<\/p>\n<p>Para la central obrera, es una mala noticia: saben que el Fuero Contencioso es af\u00edn a la gesti\u00f3n Javier Milei y convalidar\u00e1 la vigencia total de la normativa que cuestion\u00f3 mediante una cautelar por inconstitucionalidad.
